General conditions applicable to customers of biotor.eu

These general terms and conditions for customers (the “Terms and Conditions”) are applicable to any use of biotor.eu. Stores are subject to the General Terms and Conditions applicable to stores.

 

1. Definitions

Goods: means all goods, meats, sausages, dairy products, eggs, frozen foods, packaged products, snacks and fruits and vegetables, and services offered through the Platform.

Offer: represent all published Goods on the Platform that are offered to the Customer.

Order: is an Order made by a Customer to the Store through the Platform in respect of the Offer selected by the Customer

Customer: is a natural or legal person who places an Order through the Platform.

Agreement: is an agreement between the Customer and the Store regarding an Order and the delivery or receipt of the Order on site.

Platform: is the biotor.eu website, applications, tools and other devices of biotor.eu and its related companies and business partners through which the Service is provided.

Service: are the commercial services and/or activities offered to the Customer by biotor.eu, which include publishing the Offer, facilitating the conclusion of Agreements and handing over the Orders to the respective Store.

biotor.eu: is a site through which Customers can purchase the Goods offered by BIOTOR 2 EOOD online.

3. Applicability

1. These General Terms and Conditions primarily cover the purchase of goods on our Platform. They apply to the purchase of goods on the Internet or on our customer phone line.

2. By placing an Order, the Customer directly concludes an Agreement with the Store for the delivery of the Offer selected by the Customer. The Customer is bound by the Order and is not entitled to a refund, unless biotor.eu allows the cancellation of Orders in accordance with section 6 below.

 

4. Offer

1. The Store publishes the Goods on the Platform, in accordance with the Information provided by the Store.

2. The Platform presents Information about the Store in such a way that it is clear to the Customer what his rights and obligations are after ordering the Offer/concluding an Agreement.

3. The store is not responsible for temporary/permanent unavailability of the Platform.

 

5. The Agreement

1. The Agreement enters into force from the moment the Customer completes the Order by clicking on the “Order” button.

2. After receiving the Order, the Store will confirm the Customer’s Order electronically.

3. The Agreement can be executed by the Store only if the Customer provides accurate and complete contact and address information when submitting the Order. The Customer is obliged to immediately report any inaccuracies in the payment data specified or provided to the Store.

4. After submitting the Order, the Customer must be available to contact the Store by phone or e-mail (specified when submitting the Order) in connection with information on the status of the Order.

 

6. Termination of the Agreement and cancellation of the Order

1. Orders cannot be canceled by the Customer through biotor.eu. The Customer can cancel the Order with the Store, only if the Store has explicitly indicated another possible cancellation of the Order or part of the Order by the Customer, except for the one specified in Art. 1 of this chapter.

2. The Store has the right to cancel the Order, for reasonable reasons, such as if the Offer is no longer available, if the Customer has provided a wrong/non-working phone number or other contact information or in case of force majeure.

3. If the Customer submits a false Order (for example, by providing incorrect contact information, does not pay or is not present at the place of delivery or collection to pick up the Order) or otherwise fails to fulfill its obligations under the Agreement, the Store has the right to refuse future Orders from the Customer.

4. The Store has the right to refuse Orders and cancel Agreements if it has reasonable doubts about the accuracy or authenticity of the Order or contact details. If the Store cancels an already paid Order, it returns the paid amount to the same account from which the payment was made. If the Customer places Orders that appear to be incorrect or fake, the Store may notify the relevant authorities.

 

7. Payment

1. From the moment of concluding the Agreement in accordance with the provisions of section 5, point 1 of these General Terms and Conditions, the Customer is obliged to pay the Order to the Store. The Customer may fulfill this payment obligation by using an online payment method through the Platform or by paying the Store upon delivery to the door or at the point of collection.

2. The store accepts online payment by card via biotor.eu.

3. When returning goods paid for by card, the amount will be refunded to the account of the same card.

 

8. Delivery

Orders placed in the biotor.eu online store. are processed and sent to you, after mandatory confirmation by phone – we will contact you on the number you left us within 24 hours, from Monday to Friday, from the moment you have completed your order. Orders placed on weekends are processed, confirmed and shipped on the first business day after the day they were placed. The goods ordered from the biotor.eu online store are delivered by the courier company “Econt Express” (http://www.econt.com/). You can choose delivery to an EKONT Express office (convenient for you) or delivery to an address.

Payment is made by cash on delivery (paid to the courier) upon delivery, after inspection of the shipment.

The cost of delivery is NOT included in the price of the goods.

The cost of delivery is determined by the courier company. For more accurate information, you can visit the courier’s website and calculate the exact shipping price at: https://www.econt.com/services/shipment-price. Delivery is made by courier from 9.00 a.m. to 6.00 p.m. /Saturday to 1.00 p.m./, deliveries are not made on Sundays and public holidays.

The delivered shipment is paid to the courier after inspection.

Deliveries are made to all settlements in Bulgaria within 3 working days from the moment of confirming your order by phone.

When an order is placed, our employee will contact you at the phone number you specified within 24 hours of finalizing your order, between 10:00 a.m. and 18:00 (from Monday to Friday) to confirm the request. If we are unable to get in touch with you on the phone number you provided with your order, we will not ship to you.

 

9. Return and exchange of purchased goods.

Replacement or return of the product (Art. 55, para. 2, item 5 of the Commercial Code) can be made within 7 days after receipt of the goods, if the following circumstances are established at the time of receipt by the courier:

– Damaged packaging – torn or unglued;

– Discrepancy of the requested quantity;

– Inconsistency of the delivered with the requested product;

– Visible product defect.

In case of refusal to accept the shipment, return or exchange of purchased goods, the courier costs are borne by the customer.

 

10. Dispute Resolution

1. If the Customer has a complaint regarding the Service, he must communicate it to the customer service center of the Store through the contact form, by e-mail or by regular mail to the contact address specified in section 2 of these General Terms and Conditions.

2. After receiving the complaint, the Store responds as soon as possible, but no later than one week after receipt, with confirmation of receipt. The store considers the complaint as soon as possible, but no later than two weeks after sending a confirmation of receipt.

3. Complaints under section 8, point 1 and 2 shall be filed promptly after the deficiencies have been identified by the Customer, and shall be described fully and clearly on biotor.eu (section 8, point 2 above).

 

11. Information Bulletin

1. When placing the Order, the Customer may also subscribe to the newsletter. The Customer may cancel their subscription by contacting the Customer Service Center using the contact details specified in “Correspondence Address” in Section 2 of these Terms and Conditions.

 

12. Processing and stored personal data

1. The store processes personal data related to the Customer. Personal data is processed according to the Personal Data Processing Policy.

 

13. Governing Law

1. Invalidity or unenforceability of any provision of these General Terms and Conditions shall not affect the validity or applicability of the remaining provisions. The current legislation of the Republic of Bulgaria applies to the content of these General Terms and Conditions.

2. With each order from biotor.eu, whether by phone or via a mobile application, the Customer confirms that he/she is familiar with and agrees to these General Terms and Conditions.
